How to calculate the volumetric weight of your shipment?

Please note that is very important to make the difference between Gross Weight and Volumetric Weight, as it will determine the price of the freight.Β 

The equivalence rule in air freight is 1t = 6 CBM. The volume must be divided by 6 and compared to the Gross Weight of the goods and choose the higher of the two. To the advantage of the airline company.

How much will I pay ?Β 

Hong Kong is a duty free destination and maintains basically no barriers on trade. It means that Hong Kong does not impose any duties or taxes collecting for general commodities on its territory. Only some specific products are subjected to payment such as alcohol, tobacco, petroleum and chemical products. Most of importations on the territory do not need license as well. Importers should purchase a license only in the case of specific products as mentioned above.

However, it is to be noted that any importer should file an β€œimport declaration” through the β€œCustoms and Excise Department” system and provide documents such as: invoice, bill of lading, airway bill, packing list, etc.

The ASEAN-Hong Kong China Free Trade Agreement (AHKCTA)

Since June 2019, The ASEAN countries (Association of South East Asian Nations) which of course the Vietnam is a part, signed an agreement with Hong Kong and China.

Vietnam issuedΒ Decree No. 07/2020/ND-CPΒ on the special preferential import tariffs for the implementation of the ASEAN-Hong Kong China Free Trade Agreement (AHKFTA).

The reason of this agreement is to increase economic cooperation, reduce taxes, and increase investment between ASEAN markets and Hong Kong.

The preferential import tax rates are applicable under the following conditions:

  • Imported commodities are listed in the special preferential import tariff under the Decree
  • Imported from countries that are part of the AHKFTA
  • Transported directly from the exporting country part of the AHKFTA
  • Provide of the certificate of origin (C/O).

The Bill of Lading is equivalent to a passport and a boarding card for your shipment. Depending on the method used to transfer your goods, it can be an Airway Bill (for Air Freight) or a Bill of Lading (for Ocean Freight). This document is very important if you’re wishing that your import can be treated under any preferential import tariff. It is the only legal document to prove the origin of your goods. Like the Bill of Lading, the Certificate of Origin is a very important document for all international import. The document must be signed by the manufacturer and delivered by a government agency of the country of origin.

Different taxes existing for your goodsΒ 

TVA

Import VAT is due on the customs value plus the duty paid value. This is fixed at 5% (including the local taxes).
Due to the large public debt and the relatively low general VAT rate, the Japanese government decided on December 30, 2011 to increase the rate to 8% in 2014 and 10% in 2015. This decision is highly controversial and its approval by the parliament is not certain.

 

The excise tax in Japan

Japan applies excise duties on a number of products (Law No 37 on the collection of excise duties on imports, 1955). These are the tobacco products, fuel and alcohol.

Under the Liquor Tax Act (No. 6, 1953), the following tariffs are in force:

  • For beer with an alcohol content of less than 20%: JPY 220,000/kl ;For wine: JPY 80,000/kl;
  • For whisky, cognac and other alcoholic beverages with an alcohol content of less than 37%: JPY 370,000/kl;
  • For whisky, cognac and other alcoholic beverages with an alcohol content of 37% or more: JPY 370,000/kl + JPY 10,000/kl for each percent above 37%;
  • For liquor with an alcohol content of less than 13%: JPY 120,000/kl.

 

How to get a taxes exemption?Β 

You have a way to get a partial or total exemption in GSP countries (including Vietnam). For the rest, it will depend on the nature of what you import and the country of importation.

 

Β GSPΒ 

The Generalized System of Preferences (GSP) is a program of trade preferences for goods from developing countries, established by several developed countries within the framework of the World Trade Organization. Without negotiation or reciprocity, it does not apply to the customs duties of poor countries, but only to their exports; It is a system of aid for developing countries to support them in their trade. Therefore, a lot of Vietnamese products are included.

Products too competitive (textile for example) won't beneficiate from GSP.

What are the Licenses required ?

Import license ?

Most goods are exempt from presentation of an import authorization. However, Article 7 of the Customs Code provides that for certain goods, an import authorization must be presented in advance, without which Japanese customs will not be able to clear the goods concerned through customs.

This point is further elaborated by Art. 52 of the Foreign Trade and Commerce Act and Art. 3 of the Decree on the Control of Import Trade. These include perishable goods, goods from specific countries for which marketing restrictions have been established, whale products from countries that are not members of the International Convention for the Regulation of Whaling, etc. The import trade is regulated by article 52 of the Foreign Trade and Commerce Act and article 3 of the Decree on the Control of Import Trade. For the import of goods for which a quantitative import quota system exists, it must also be possible to present an authorisation. These include explosives, raw silk, certain species of fish, substances affecting the ozone layer, medicines, products of animal species or of endangered plants (falling under the CITES Convention) and military equipment and weapons. The latter are also subject to export authorisation.

It goes without saying that the import of goods that may present a risk to the environment is subject to an export licence for safety or health (nuclear material, medical devices, foodstuffs, insecticides, veterinary products, cosmetics, toiletries, etc.) is also subject to provisions involving technical checks and the presentation of certificates (analysis, free sales, etc.) and supporting documents.Β  Opium may only be imported by a specialised agency of the Ministry of Health.The import and sale of milk and milk products is controlled by agricultural professionals. Rice, wheat and barley are even more heavily regulated given their importance in the Japanese food chain.

Japan and Vietnam concluded a broad Economic Partnership Agreement in 2008 that provides for a bilateral expansion of trade, with reductions in customs duties on nine-tenths of the products and services concerned. Japanese Foreign Minister Hirofumi Nakasone and Vietnamese Industry and Trade Minister Vu Huy Hoang initialled the document on Thursday. Different taxes existing for your goodsΒ 

VAT

As you can imagine, when you export to Spain outside the EU (Vietnam), you have no choice but to pay taxes (VAT) and customs duties.

In Spain, as far as importing products is concerned, there is 21% VAT. However, for some products there is a reduced VAT, called reduced VAT: 10%.

Insurance costs but also the value of your goods will influence the amount of VAT you will owe.

 

The excise tax in Spain

Each EU Member State applies its own excise duties on alcoholic beverages, manufactured tobacco and energy products (fuels and combustibles, such as oil and gasoline and coal). The revenue from these rights accrues in full to the Member States.
The Spanish taxes for are set as follows :
- 16% on alcohol
- from 12.5% to 22.5% on tobacco, the rate varying according to their type.

Similarly, their transport must be made under cover of an accompanying administrative document (AAD), or a simplified accompanying document. (DSA). These documents are available in all local recipes.

Special cases of the Canary Islands, Ceuta and Melilla
Any consignment of Community goods to one of these territories shall be treated as an export and is subject to a customs declaration (SAD single administrative document) in the member country of dispatch. In the territory of destination, the operation is also treated as an import and subject to local taxation.

The Canarian Indirect General Tax (IGIC) substitutes VAT in the territory and has four tax rates: aΒ general tax rate of 5%, a general tax rate of 5%, a general reduced rate of 2% (fuels, energy, textiles), an increased rate of 13% on luxury goods and 0% on water, medicines and educational goods.
In order to compensate for their insularity and to protect their local products, the Canary Islands also apply the AIEM (Arbitrio sobre Importaciones y Entregas de MercancΓ­as en las Islas Canarias), which is the equivalent of a dock dues.

 

How to get a taxes exemption ?Β 

There is a way to benefit from partial or total exemption in "GSP" countries (Vietnam is part). For the rest, it will depend on the nature of what you import and the country of importation. Ask us to be sure.

  • a summary declaration (air or sea manifest) for taking over the goods

The SAD form can be obtained from chambers of commerce or an approved printer. A computerized customs clearance platform (SOFI) is available at customs offices or at certain chambers of commerce.

Within the framework of the SAFE standards advocated by the World Customs Organisation (WCO), the European Union has introduced a new import control system, the Import Control System (ICS), which aims to secure the flow of goods upon entry into the EU customs territory. This control system, which is part of the EU's eCUSTOMS programme, has been in force since 1 January 2011. Since this date, it has been mandatory for traders to submit an Entry Summary Declaration (ENS) to the customs office of the country of entry prior to the entry of goods into the customs territory of the European Union.

What are the Licenses required (import & export)?

Agricultural Products
Importing agricultural products : Most part need import licence to be imported. It will be used by the Spanish authorities. This is a way for them to manage the tariff quotas.
In order to obtain the corresponding licence, a financial guaranty must be provided to the authorities in question.

Note that these imports are monitored and controlled by Spain autorities ; a surveillance document must be provided when the weight of the imports exceeds 2500 kg.

Trade agreementΒ 

MEPs ratified the EU-Vietnam free trade agreement by a large majority. Signed in Hanoi last June. They also gave the go-ahead for a second agreement on investment between the two blocs. However, this latter text will have to be ratified by some 40 European national parliaments before it can be implemented. The trade agreement could start as early as this summer.

Both agreements "are the most ambitious ever concluded with a developing country", said EU Trade Commissioner Phil Hogan in a debate on Tuesday. With €47.6 billion worth of trade in goods, Vietnam is the EU's second largest trading partner in South East Asia. In 2018, Vietnam has a trade surplus of almost €30 billion with the EU.

Almost all trade flows between the two blocs will see tariffs reduced to zero in the near future. For some goods, such as cars, complete elimination will take ten years.

The agreement also includes rules on working conditions, respect for the environment, intellectual property and human rights in this growing South East Asian country.

Sea freight from Vietnam to Russia

Overview - Ocean cargo from Vietnam to Russia

The country is fairly open to foreign trade, which accounts for 51.5% of GDP (World Bank, 2018), despite strict laws and policies. Russia became a member of the WTO in 2012, a member of the Commonwealth of Independent States, which established a free trade zone, and is a member of the Eurasian Customs Union. Russia and Ukraine have abolished their mutual trade preferences. The Eurasian Customs Union has signed an agreement with Vietnam and is negotiating free trade agreements with e.g. Iran, India, Egypt, Singapore and Serbia. Russia is the 14th largest exporter and 22nd largest importer of goods in the world (WTO, 2018). Its main exports are hydrocarbons (more than 50% of total exports), solid fuels, iron and steel, wheat and meslin, precious stones, precious metals and wood, and its main imports are machinery, pharmaceuticals, electronic equipment, vehicles and plastics.

Russia's main trading partners are China, Germany, the Netherlands and Belarus. Since the conflict in Ukraine and the economic sanctions imposed by Western countries, the Kremlin has imposed an embargo on European and American agricultural products and has reconfigured its trade relations. The country has recorded significant and regular trade surpluses since 1998, mainly due to its rich natural resources, especially hydrocarbons (crude oil and natural gas in particular).

Ust-Luga, Europe's seventh largest port, is to become an important port for coal and fertilisers with a planned capacity of 35 million tonnes per year. Its construction started in 1997 with the aim of avoiding the need to route traffic through Baltic ports. The work was accelerated by Vladimir Putin, who inaugurated it in 2001. The 3,700-metre-long approach channel can accommodate ships of over 150,000 tonnes. In 2016, almost 90 million tons will have passed through it.

 

Port of Primorsk

Primorsk, Europe's twelfth largest port, is the largest Russian port on the Baltic Sea in terms of traffic. The terminal was commissioned in 2001 and its traffic reached 45 million tons in 2004 2 and 74.2 Mt in 2007 3. In 2010, the port of Primorsk is the 2nd Russian port, behind Novorossiysk, on the Black Sea, with a traffic of 77.64 Mt; Primorsk is also the 46th largest port in the world.

 

Port of Saint Petersburg

Now the second busiest port on the Baltic Sea, the city increased its industrial production by 19% in 2004. River-sea developments (canals joining "the five seas", i.e. the Baltic Sea, the White Sea, the Black Sea, the Sea of Azov and the Caspian Sea) have been an important element in the development of the seaport of St Petersburg. St. Petersburg, enjoying a privileged geographical location, is the third largest ex-Soviet port on the Baltic Sea. In 2004, 14.62 million tonnes of goods transited through the seaport of the second largest city in Russia, an increase of 19% over the previous year. The net profit of the company, which employs 430 people, was 28.2 million roubles (almost $1 million) in 2004.

 

Should I ship by consolidation or full container from Vietnam to Russia ?

LCL

LCL - Less Than Container Load : In this case we also speak of "consolidation". In fact, this option is available for you who may not have enough volume to make an FCL profitable (if it is expensive, you might as well fill it). The freight forwarder has several customers with similar needs for the transport of small consignments within the same trade - and offers to consolidate these consignments into a shared container. In this way, shipping costs are divided among the customers according to the space they occupy in the container.

FCLΒ 

FCL is an ISO international standard. Thus it designates the (full) container load (20β€³ or 40β€³) containing a shipment for an importer (consignee).

It will therefore be more complicated to make this kind of FCL profitable, unless your volume reaches 13,14,15 CBM.

In addition, there is no risk of water damage since the cargo is always well secured inside the ship throughout the voyage. These special vessels also carry non-motorized or non-roadworthy vehicles.

BULK:

Bulk goods are goods that are transported in large quantities. They are liquid or granular materials, in the form of particles, such as a mass of relatively small solids, such as oil/crude oil, grain, coal or gravel. This cargo is usually dropped or poured, with a bucket or shovel, into the hold of a bulk carrier, railway car, or tanker/trailer/semi-trailer. Smaller quantities (always considered "bulk") may be boxed and palletized. Bulk goods are classified as either liquid or dry.

Different taxes existing for your goodsΒ 

Since its official entry into the WTO on 22 August 2012, Russia has undertaken to apply all WTO provisions, including an average customs duty of 7.8% for goods.

The majority of imports are subject to 18% value added tax (VAT). A reduced rate of 10% is imposed on basic foodstuffs, children's items, school books and medicines. A limited number of goods are exempt from VAT, including pharmaceuticals and medical equipment and products for the disabled. This tax is applied to the sum of the amount of the goods, customs duties and excise tax.

Imports delivered and used in the Special Economic Zones are free of duty and VAT. Customs duties and VAT must be paid when the goods concerned are shipped to the rest of Russia.

 

The excise tax in Russia

Certain categories of goods imported into Russia are subject to payment of excise tax (for example, alcoholic beverages, cigarettes, etc.) As a rule, the rate of excise tax is specific (that is, it is defined by the volume, weight, or other characteristics of the goods).

 

How to get a taxes exemption?Β 

It’s possible for you to benefit from partial or total exemption in GSP countries (including Vietnam). For the rest, it will depend on the nature of what you import and the country of importation.

The Generalized System of Preferences (GSP) : Under this system, developed countries apply lower tariffs to products from poorer countries. In order to contribute to the development of these countries, it is therefore an exception to a cardinal principle of the World Trade Organization.(WTO), the most-favoured-nation clause, according to which an advantage granted to one member country of the organisation must be granted to all the others.

Since the EU opted for this system (1971), the Generalised System of Preferences has been an important instrument of EU trade policy. Without negotiation or reciprocity, it does not apply to the customs duties of poor countries, but only to their exports; It is a system of aid for developing countries to support them in their trade. Then, you can guess that a lot of Vietnamese products are included.

A reform of customs regulations has been carried out since the end of 2000. It has led to a general reduction in customs tariffs and the entry into force of a new Customs Code on 1 January 2004. Generally speaking, it reflects a harmonisation of customs procedures with European standards.

Most goods are free to be imported into Russia, although there is a licensing system for certain specific products (pesticides, jewellery and precious materials, electrical equipment, etc.) which account for about 3% of total imported goods. These licenses are issued by the Ministry of Foreign Economic Relations and monitored by the State Customs Committee.

The customs declaration can be made by the declarant of a company under Russian law and forwarded to the customs office where the company is first registered. A company exporting to Russia may also use the services of a customs broker who will carry out customs formalities on its behalf. Release for consumption, with immediate payment of duties and taxes, is the regime most commonly used by operators exporting to Russia.

Goods shipped to Russia must be accompanied by the following documents:

  • The Single Administrative Document (SAD)
  • The commercial invoice (It must be drawn up in triplicate in English or Russian and contain the usual particulars. It must specify the customs terminal number)
  • A health certificate
    They are required for meat and are issued by the Departmental Directorate of Veterinary Services.
  • Certificate of conformity to Russian standards (GOST-R)
    It is necessary for products that may present a danger to health or environmental protection (food products, chemicals, consumer goods, etc.).

Russia applies the Harmonized Customs System. The customs tariff is composed of 11,032 tariff lines of which 85% is imposed on an ad valorem basis . Duties and taxes are collected by the State Customs Committee.

What are the Licenses required (import & export)?

Import licenseΒ 

Licences are required to import a variety of products, including for health, safety and national security reasons. These products include radioactive substances, explosives, drugs and pharmaceuticals, information protection devices (including all encryption systems and software), alcohol (vodka), tobacco products, self-defence tools, weapons, and military equipment. These import permits are usually issued by the Department of Trade and Economic Development or the Department of Defence in the case of military equipment or dual-use goods).

 

Necessary documentsΒ 

The bill of lading is the document of title which is given by the sea carrier, or his representative, to the shipper who owns the goods in recognition of the goods his ship is to carry. The nature, weight and marks of the goods shipped are recorded on this document. This document is signed by the master after receipt of the goods, with an undertaking to deliver them in the condition in which he received them, at the place of destination, except for perils and accidents at sea. The bill of lading shall be drawn up in four copies. The original document is not a title to the goods, but it is representative of the goods and is negotiable. The other three copies shall be for the master of the vessel, the shipowner and the seller.

Trade agreementΒ 

Russian President Vladimir Putin ratified the Free Trade Agreement between the Eurasian Economic Union (EAU) and Vietnam on 1 May. At the end of April, the State Duma and the Council of the Russian Federation also ratified this agreement which was signed in May 2015 in Bourabay to facilitate economic exchanges between Vietnam and this Union which includes Russia, but also Belarus, Armenia, Kyrgyzstan and Kazakhstan. It will provide for exemption from customs duties for a number of goods and the application of safeguard, anti-dumping and countervailing measures, in accordance with World Trade Organisation (WTO) regulations.

Annual trade between Vietnam and the EAU averages around $4 billion. The signing of their free trade agreement will raise it to $10 billion by 2020.

Vietnam's ambassador to Russia, NgΓ΄ Duc Manh, stressed the positive development of relations between the two countries last year during a meeting with representatives of Russian and Vietnamese news agencies held in Moscow on Wednesday 30 January.
Ngo Duc Manh said bilateral relations had developed in all areas: politics, economics, defense-security, science-technology, education and relations between the two peoples. In politics, mutual confidence has been strengthened by frequent exchanges of delegations over the past year, including the visit to Russia of the Secretary General of the Communist Party of Vietnam, Nguyen Phu Trong, and trips to Vietnam by Russian Prime Minister Dmitry Medvedev and Duma Speaker Viacheslav Volodin.

One of the strengths of the bilateral relationship is the growing cooperation in defense and security, Ngo Duc Manh said, noting that for the first time Vietnam participated in the Army Games military demonstration party in Russia and ships of the Russian Pacific Fleet visited the port of Cam Ranh, Vietnam.

By taking advantage of the strengths of the free trade agreement between Vietnam and the Eurasian Economic Union, of which Russia is a member, companies from both countries have strengthened their economic, trade and investment partnership, the diplomat said.

Strengthening economic cooperation :

According to Vietnam's General Customs Department, bilateral trade reached $4.57 billion in 2018, up 28.6% from the previous year.

Building on the positive energy cooperation, the two sides promoted key joint projects, including the Centre for Nuclear Science and Technology Development Projects and Urban Transport in Vietnam.
NgΓ΄ Duc Manh added that the two sides had also extended their collaboration to digital technologies, e-government, renewable energy and the production of seeds, pesticides, medical equipment and pharmaceuticals. On tourism, the number of Russian visitors to Vietnam has reached a record of more than 600,000 in 2018, making it the largest in Europe and the sixth largest source of tourists, he said.

Ambassador NgΓ΄ Duc Manh said the two countries would celebrate the 25th anniversary of the signing of the Treaty on Principles of Friendship between Vietnam and Russia, and were preparing to mark 70 years of bilateral diplomatic relations in 2020.

He expressed his conviction that the Year of Friendship would be successful and contribute to strengthening the bilateral partnership.
